By entering the Wild Swimming Cornwall website you agree to abide by the Terms and Conditions of use. You are deemed to have accepted these terms on your first use of the website. Where alterations are made, you are deemed to have accepted the new terms on your first use of the website following the alterations.
SWIM RESPONSIBILITY STATEMENT
Wildswimmingcornwall.co.uk, Kelp Studios and companies and persons supporting wildswimmingcornwall.co.uk are unable to assume any legal responsibility for swimmers.
Whilst we are passionate in sharing our love for outdoor swimming and its benefits, all persons partaking in swimming must be solely responsible for making their own risk assessments before partaking in any swim. We have provided some guidance on swimming health and safety, however this is not exhaustive and the decision to swim must not depend either partially or wholly on this information. Conditions change and abilities vary, and the associated risks of swim spots change over time. By swimming outdoors you are at heightened risk of injury and harm, including cold water shock, hypothermia, drowning, sickness and injury (for example, from wildlife, other swimmers, underwater debris, water pollution and more).
Wildswimmingcornwall.co.uk and Kelp Studios do not have any insurance in place. The decision to take part in outdoor swimming must be taken individually and must not depend either partially or wholly on the information provided on this website or any of our other communication channels.
When making the decision to swim, it is crucial to know your limits. If you are in any doubt about the safety of a swim or your ability to complete it, you should refrain from entering the water.
Individuals acting on behalf of wildswimmingcornwall.co.uk and Kelp Studios, any persons supporting them or involved exclude, to the maximum extent permitted by law, any liability for personal injury, death or other harm or loss to any person or organisation as a result of a breach of legal duty or negligence.
SALES
Once you have submitted an order you will be given an Order Reference Number and the details of the products you have ordered. You will receive confirmation via email. When an order has been submitted on the website, we can reject it for any reason. Where this is the case we will try to tell you the reason without delay. Your card will be charged automatically when you place your order. If for any reason we are unable to fulfill your order, a full refund will be given.
COPYRIGHT
The 1988 Copyright Act assigns the copyright to the photographer. It is contrary to the Act and strictly illegal to copy or allow to be copied, any photographs covered by this contract. Sale, publication or any commercial use of the photographs is not allowed without prior written permission from the photographer. This contract is governed by the law of England and Wales. Disputes can be submitted to the jurisdiction of the courts of England and Wales, or, where the customer lives in Northern Ireland or Scotland in their respective courts.
